Each of Vermont's fourteen counties has a Probate Court. The four southern counties - Bennington, Rutland, Windham and Windsor - also have a second Probate Court district. Probate Courts have jurisdiction over:

  • administration and settlement of estates
  • trust estate administration and settlement
  • adoptions and emancipation of minors
  • guardianship of persons unable to manage their own affairs
  • custody of minors to someone other than either parent
  • vital record corrections and establishments, including change of name

Litigants in cases heard in Probate Court may hire attorneys to act on their behalf during court proceedings or may choose to represent themselves. There are no jury trials.

Vermont's 18 Probate Court judges are elected to four year terms by the voters in each Probate district; judges are not required to be lawyers. Probate Court registers and their staff are responsible for the daily operations of the Court.
