Correction of a Birth Certificate  |  Establishment of a Birth Certificate

Correction of a Birth Certificate:

In the situation where a birth certificate contains incorrect information it is possible to have it corrected through the Probate Court. Minor errors and obvious error may be corrected by the Town Clerk within six months after the date of birth. For corrections which are taking place six months after the birth, the correction must take place at the Probate Court for the county in which the petitioner was born.

Instructions:

To petition for the correction of a birth certificate please download a copy of the Petition Form from the above link. Forms are also available at the Probate Court.

The Petition needs to be completed and signed and a Certified Copy of the Birth Certificate to be corrected needs to be attached. If the correction is for a minor, then both parents must sign the petition or notice must be given to the parent who does not sign the petition. You also need to include at least three (3) documents giving evidence of the correction needed. Acceptable documentation includes but is not limited to: Baptism Record, Marriage Certificate, School Records, and/or Medical Records.

Once the Petition is complete and the required documents are attached, please file the material with the Probate Court. Please keep a copy of the Petition for your records.

Correction of a Birth Certificate for Legitimacy Purposes:

In the situation where the legitimacy of the holder of the birth certificate was not or was incorrectly established it is possible to correct paternity information through the Probate Court.

Instructions:

To petition for the correction of a birth certificate for legitimacy purposes please download a copy of the Petition Form from the above link. Forms are also available in the Probate Court.

The Petition must be completed, signed by both parents, accompanied by a certified copy of the Birth Certificate and a copy of DNA Test Results. The Petition may also be accompanied by a Disclaimer of Paternity (if applicable) and a certified copy of the Marriage Certificate (if applicable).

The Petition may be mailed or personally delivered to the Probate Court during the Court’s normal hours of operation. If you are mailing the Petition, please include the filing fee of $25.00. Please keep a copy of the Petition for your records.

Establishment of a Birth Certificate:

In the situation where a birth certificate does not exist or cannot be located, it is possible to have the Probate Court establish one. The establishment of birth certificates must take place at the Probate Court for the county in which the petitioner was born.

Instructions:

To petition for the establishment of a birth certificate, please download a copy of the Petition for Establishment of Birth Certificate from the above link. Forms are also available in the Probate Court.

The completed and signed Petition must be accompanied by four (4) official documents supporting the evidence presented on the Petition. Acceptable documents include: Baptismal Records, Medical Records, School Records, Affidavit (notarized statement) of person having knowledge of the birth, Marriage Certificate, and/or Service Records. All documents submitted with the Petition must show name of person, date and place of birth, and names of both parents.

The Petition can be mailed or personally delivered to the Probate Court. If you are mailing the Petition, please include the filing fee of $25.00. Please keep a copy of the Petition for your records.
