purchased the subject parcel and improvements at <st1:Street><st1:address>=
2106
  River Road</st1:address></st1:Street> in 2003.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>The property contains approximate=
ly five
acres of land, but is surrounded by hundreds of acres of forested land.<sp=
an
style=3D'mso-spacerun:yes'>&nbsp; </span>It is in the Village&#8217;s RR d=
istrict.</p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>3.<span
style=3D'mso-tab-count:1'>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;=
 </span>The
Old English Inn, the centerpiece of the property, was originally built in =
1903
and is a large twenty-two room structure surrounded by trees and virtually
invisible from River Road.<span style=3D'mso-spacerun:yes'>&nbsp; </span>T=
he
building&#8217;s closest neighbors are approximately two hundred yards to =
the west.
<span style=3D'mso-spacerun:yes'>&nbsp;</span>The Old English Inn&#8217;s =
former
owners used it as a rooming house serving hikers and long-term tenants,
including members of the Target Program at Burr and <st1:place><st1:PlaceN=
ame>Burton</st1:PlaceName>
 <st1:PlaceType>Academy</st1:PlaceType></st1:place>.</p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>4.<span
style=3D'mso-tab-count:1'>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;=
 </span>Appellee-Applicants
propose using the Old English Inn as a facility to implement Dr. Levis&#82=
17;
emotional education program entitled &#8220;Creativity and Power Managemen=
t,&#8221;
which &#8220;consist[s] of theory and instruments [sic] . . . incorporat[i=
ng] many
therapeutic modalities integrated into one single unified conceptual and
therapeutic model that proceeds from understanding behavior to helping the
individual to understand oneself and to gradually develop skills.&#8221;<s=
pan
style=3D'mso-spacerun:yes'>&nbsp; </span>Aff. of Albert Levis, at &para;2.=
</p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>5.<span
style=3D'mso-tab-count:1'>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;=
 </span>Dr.
Levis proposes to conduct various programs ranging in length from a weeken=
d to
two weeks or longer, with a variety of activities, lodging, and food servi=
ce,
all centered on the promotion of Dr. Levis&#8217; psychotherapy study.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>The facility will be run by a <st=
1:State><st1:place>Vermont</st1:place></st1:State>
not-for-profit corporation entitled the &#8220;Institute for Conflict Anal=
ysis
and the Museum of the Creative Process.&#8221;</p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>6.<span
style=3D'mso-tab-count:1'>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;=
 </span>According
to Dr. Levis, his program &#8220;effectively educates about behavior, assi=
sts a
person to find [out] about oneself, provides a person with new non-stigmat=
izing
diagnostic information with clarity on what changes are necessary to relie=
ve
symptoms, and provides a person with information on how to bring about such
changes.&#8221;<span style=3D'mso-spacerun:yes'>&nbsp; </span>Aff. of Albe=
rt
Levis, at &para;3.</p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>7.<span
style=3D'mso-tab-count:1'>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;=
 </span>According
to a sample schedule, Dr. Levis&#8217; offering will be entitled &#8220;Te=
leion
Holon,&#8221; (greek for &#8220;The Perfect Universe&#8221;) and will incl=
ude
classes or seminars.<span style=3D'mso-spacerun:yes'>&nbsp; </span>The pro=
posed
activities appear to range from studies of science, psychology, morality, =
and conflict
resolution to yoga, tai-chi, and nature walks.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Dr. Levis also proposes using nea=
rby
museums and art galleries as part of the proposed programs.</p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>8.<span
style=3D'mso-tab-count:1'>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;=
 </span>Possible
clients of Dr. Levis&#8217; proposed facility include patients, medical and
mental health professionals, and educators.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>At some point, Dr. Levis intends =
to
conduct conferences for different professionals, possibly in conjunction w=
ith
his facility at the nearby Wilburton Inn.</p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>9.<span
style=3D'mso-tab-count:1'>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;=
 </span>Appellee-Applicants
presented their application to the Village ZBA to operate Dr. Levis&#8217;
center at the Old English Inn as a conditional use on <st1:date Month=3D"4"
Day=3D"26" Year=3D"2004">April 26, 2004</st1:date>.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>The ZBA approved
Appellee-Applicants&#8217; conditional use application with conditions aft=
er an
additional hearing and a deliberative session on <st1:date Month=3D"5" Day=
=3D"17"
Year=3D"2004">May 17, 2004</st1:date>.</p>

u></b></p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>Appellee-Applicants
moved to dismiss this appeal, alleging that Appellant does not have standi=
ng to
appeal because he does not meet the statutory requirement that an interest=
ed
person participate in the municipal proceedings in order to have standing =
to appeal
that municipal panel&#8217;s decision.<span style=3D'mso-spacerun:yes'>&nb=
sp;
</span>24 V.S.A. &sect; 4471(a) (2004).<span style=3D'mso-spacerun:yes'>&n=
bsp;
</span>This section became effective on <st1:date Month=3D"7" Day=3D"1" Ye=
ar=3D"2004">July
 1, 2004</st1:date>.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Because=
 the
decision appealed from was rendered on <st1:date Month=3D"6" Day=3D"21" Ye=
ar=3D"2004">June
 21, 2004</st1:date>, we apply the provisions of the Vermont Planning and
Development Act in effect at that time.<span style=3D'mso-spacerun:yes'>&n=
bsp;
</span>The Act&#8217;s provisions in effect prior to July 1, 2004, only re=
quire
Appellant, as an interested person, to own property in the &#8220;immediate
neighborhood of a property which is the subject of&#8221; a ZBA decision, =
and
that Appellant allege that if the decision on appeal is upheld, it &#8220;=
will
not be in accord with the policies, purposes or terms of the plan or bylaw=
 of
the municipality.&#8221; <span style=3D'mso-spacerun:yes'>&nbsp;</span>24 =
V.S.A.
&sect; 4464(b)(3) (2003).</p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>In
this instance Appellant has met the second requirement of &sect; 4464(b)(3=
).<span
style=3D'mso-spacerun:yes'>&nbsp; </span>The only issue in the motion to d=
ismiss
is whether Appellant has met the first requirement; that is, whether the
property owned or occupied by Appellant is &#8220;in the immediate
neighborhood&#8221; of Appellee-Applicants&#8217; project.<span
style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>This
Court stated in <u>Appeals of National Realty &amp; Development Corp.</u>,
Docket Nos. <st1:date Month=3D"2" Day=3D"22" Year=3D"2003">22-2-03</st1:da=
te> Vtec,
61-4-03 Vtec, 68-5-03 Vtec and 114-7-03 Vtec (Vt. Envtl. <st1:State><st1:p=
lace>Ct.</st1:place></st1:State>,
<st1:date Year=3D"2003" Day=3D"25" Month=3D"7">July 25, 2003</st1:date>) t=
hat:</p>

<p class=3DMsoNormal style=3D'margin-top:0in;margin-right:.5in;margin-bott=
om:0in;
margin-left:.5in;margin-bottom:.0001pt;text-align:justify'>[t]here is no
specific physical radius or distance, either as the crow flies or along the
roadways, for determining whether an appellant&#8217;s property is &#8216;=
in
the immediate neighborhood&#8217; of a project&nbsp;.&nbsp;.&nbsp;.&nbsp;.=
 <span
style=3D'mso-spacerun:yes'>&nbsp;</span>Rather, to determine whether a put=
ative
appellant is &#8216;in the immediate neighborhood&#8217; under
&sect;&nbsp;4464(b)(3), we look to the physical proximity of the two
properties, and examine other factors as well.</p>

<p class=3DMsoNormal style=3D'text-align:justify;line-height:150%'><st1:St=
ate><st1:place><u>Id</u>.</st1:place></st1:State>,
slip op. at 2.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>Because
Appellant&#8217;s property is located at <st1:Street><st1:address>2240 Riv=
er
  Road</st1:address></st1:Street>, only one-tenth of a mile from the Old
English Inn, we see no need to look at other factors.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Applying the same test articulate=
d in <u>Appeals
of Hoisington &amp; Gladstone</u>, Docket Nos. 177-9-99 Vtec, 189-10-99 Vt=
ec
and 190-10-99 Vtec (Vt. Envtl. <st1:State><st1:place>Ct.</st1:place></st1:=
State>,
<st1:date Year=3D"1999" Day=3D"29" Month=3D"11">November 29, 1999</st1:dat=
e>), where the
appellants had standing to bring the appeal because their properties were
potentially affected by the traffic to be generated from the proposed proj=
ect,
we find that Appellee-Applicants&#8217; proposal could impact Appellant&#8=
217;s
property.<span style=3D'mso-spacerun:yes'>&nbsp; </span>We therefore furth=
er find
that Appellant has standing to initiate and maintain this appeal.</p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>Appellant
moves for summary judgment on whether Appellee-Applicants&#8217; proposed =
use
can properly be considered as a conditional use permitted in the RR distri=
ct
under &sect; 5.12 of the Village Zoning Bylaw.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Section 5.12(1) allows &#8220;a m=
useum,
art center, clinic or similar philanthropic use, operated by a governmental
unit or non-profit corporation, or a community association,&#8221; to be
permitted as a conditional use in the RR District.</p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>Zoning
ordinances are interpreted according to the general rules of statutory
construction.<span style=3D'mso-spacerun:yes'>&nbsp; </span><u>In re Weeks=
</u>,
167 <st1:State><st1:place>Vt.</st1:place></st1:State> 551, 554 (1998).<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Thus, we first look to the plain =
meaning
of the ordinance.<span style=3D'mso-spacerun:yes'>&nbsp; </span><u>In re S=
towe
Club Highlands</u>, 164 <st1:State><st1:place>Vt.</st1:place></st1:State> =
272,
279 (1995).<span style=3D'mso-spacerun:yes'>&nbsp; </span>If the plain mea=
ning
&#8220;resolves the conflict without doing violence to the legislative sch=
eme,
there is no need to go further&nbsp;.&nbsp;.&nbsp;.&nbsp;.&#8221;<span
style=3D'mso-spacerun:yes'>&nbsp; </span><u>Lubinsky v. Fair Haven Zoning =
Bd.</u>,
148 <st1:State><st1:place>Vt.</st1:place></st1:State> 47, 49 (1986).</p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>Appellant&#8217;s
challenge can be characterized as whether Appellee-Applicants&#8217; propo=
sed
use of the Old English Inn is a &#8220;clinic or similar philanthropic use,
operated by a&nbsp;.&nbsp;.&nbsp;.&nbsp;non-profit corporation.&#8221;<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Bylaw &sect; 512(1).<span
style=3D'mso-spacerun:yes'>&nbsp; </span>We must view the facts relevant to
Appellant&#8217;s challenge in a light most favorable to Dr. Levis, since =
he is
the non-moving party.<span style=3D'mso-spacerun:yes'>&nbsp; </span><span
style=3D'mso-bidi-font-weight:bold'>See <u>Toys Inc. v. F.M. Burlington Co=
.</u>,
155 </span><st1:State><st1:place><span style=3D'mso-bidi-font-weight:bold'=
>Vt.</span></st1:place></st1:State><span
style=3D'mso-bidi-font-weight:bold'> 44, 48 (1990) (&#8220;The party again=
st whom
summary judgment is sought is entitled to the benefit of all reasonable do=
ubts
and inferences in determining whether a genuine issue of material fact

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>The
dictionary defines the word &#8220;clinic&#8221; as, &#8220;[a] medical
establishment run by several specialists working together&#8221; or as, &#=
8220;[a]
center that offers counsel or instruction.&#8221;<span
style=3D'mso-spacerun:yes'>&nbsp; </span><u>Webster&#8217;s II New College
Dictionary</u> 215 (3d ed. 2005).<span style=3D'mso-spacerun:yes'>&nbsp; <=
/span>While
Appellee-Applicants&#8217; proposed use can be characterized as a &#8220;c=
enter
that offers counsel or instruction,&#8221; as Dr. Levis will conduct couns=
eling
and teach classes at the Old English Inn, we are not constrained by the
dictionary definition of the term &#8220;clinic&#8221; because &sect; 5.12=
(1)
clearly permits similar uses by way of the phrase &#8220;similar philanthr=
opic
use.&#8221;</p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>The
word &#8220;philanthropy&#8221; is defined as &#8220;an institution establ=
ished
to promote human welfare.&#8221;<span style=3D'mso-spacerun:yes'>&nbsp; </=
span><u>Webster&#8217;s
II New College Dictionary</u> 846 (3d ed. 2005).<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Dr. Levis asserts that his propos=
ed
center will promote human welfare, including instruction and programs avai=
lable
to educate the patients about themselves in an effort to cure their sympto=
ms. <span
style=3D'mso-spacerun:yes'>&nbsp;</span>Notably, Dr. Levis has already
established the <st1:place><st1:PlaceType>Institute</st1:PlaceType> of <st=
1:PlaceName>Conflict
  Analysis</st1:PlaceName></st1:place> and the Museum of the Creative Proc=
ess,
the non-profit entity that would run the program. <span
style=3D'mso-spacerun:yes'>&nbsp;</span>Dep. of Dr. Albert J. Levis, at 28=
. <span
style=3D'mso-spacerun:yes'>&nbsp;</span></p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>Given
the range of non-profit philanthropic activities similar to a clinic that =
Dr.
Levis represents will be conducted at his facility, including clinical
psychology, we cannot find at this time that Appellee-Applicants&#8217;
proposed use does not fit within the enumerated uses that may be permitted=
 as
conditional uses in the RR district pursuant to &sect;&nbsp;5.12(1).<span
style=3D'mso-spacerun:yes'>&nbsp; </span>We therefore conclude that
Appellee-Applicants&#8217; request for summary judgment must be denied at =
this
time.</p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>Accordingly,
based on the foregoing, it is hereby ORDERED and ADJUDGED that both Appell=
ee-Applicants&#8217;
motion to dismiss and Appellant&#8217;s motion for summary judgment are <b
