originally represented by Kevin E. Brown, Esq., but after his motion to wi=
thdraw
was granted on <st1:date Year=3D"2004" Day=3D"24" Month=3D"8">August 24, 2=
004</st1:date>,
Defendants represented themselves until retaining W. Scott Fewell, Esq.
sometime in late 2004 or early 2005.<span style=3D'mso-spacerun:yes'>&nbsp;

ruling on Defendants&#8217; Motion for Relief from Judgment under V.R.C.P.
60(b), some discussion of the procedural history of this matter is
helpful.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>On
<st1:date Month=3D"6" Day=3D"12" Year=3D"2001">June 12, 2001</st1:date>, D=
efendant
Peter J. Nelson received approval from the Bristol Zoning Board of Adjustm=
ent (ZBA)
to run an auto repair business at <st1:Street><st1:address>81 West Street<=
/st1:address></st1:Street>.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>On <st1:date Month=3D"11" Day=3D"=
24"
Year=3D"2003">November 24, 2003</st1:date>, the Town&#8217;s Zoning Admini=
strative
Officer issued a written Notice of Violation to Defendant Peter J. Nelson =
for improper
storage of motor vehicles, the operation of a junk yard, and for an unperm=
itted
auto repair business.<span style=3D'mso-spacerun:yes'>&nbsp; </span>After =
not
receiving a response or a notice of appeal from Defendant Peter J. Nelson,=
 the
Town on February 26, 2004, issued similar written Notices of Violation to =
the
other property owners, Defendants Mark Nelson, Laura Gordon (a/k/a Lora Go=
rdon),
James N. Nelson, and Angela LaForest, for failure to obtain a zoning permi=
t for
repair of motor vehicles, for improper storage of motor vehicles, and for
operation of a junk yard without a permit.</p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>As
a preliminary matter, we find the contents of the notices of violation
sufficient to comply with the due process requirements established by our
Supreme Court in <u>Town of Randolph v. Estate of White</u>, 166 Vt. 280,
284&#8211;85 (1997).<span style=3D'mso-spacerun:yes'>&nbsp; </span>The not=
ices of
violation clearly stated the reasons for the violations and the actions th=
at
the Town will take against property owners. <span
style=3D'mso-spacerun:yes'>&nbsp;</span>The notices also stated that the
Defendant &#8220;may appeal this Notice of Violation to the Bristol Board =
of
Adjustment by filing a written Notice of Appeal, along with $20.00 fee, wi=
thin
fifteen (15) days of the date of this notice.&#8221;<span
style=3D'mso-spacerun:yes'>&nbsp; </span>See Attach. B to Defendants&#8217=

to Open Default, at 2.<span style=3D'mso-spacerun:yes'>&nbsp; </span>The n=
otices
of violation also provided an address for the filing of a notice of appeal=
.<span
style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>Although
the notice did not state that failure to appeal the violation allegations =
would
result in a final judgment as to a defendant&#8217;s violation, due process
requires only that the notices apprise Defendants of their right to appeal=
 and
how that appeal may be commenced; there is no requirement that the notices
state that failure to appeal may result in final decisions against them on=
 the
violations.</p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>On
<st1:date Year=3D"2004" Day=3D"22" Month=3D"3">March 22, 2004</st1:date>, =
the Town
commenced enforcement proceedings against all five Defendants by filing a =
Complaint
with the <st1:Street><st1:address>Environmental Court</st1:address></st1:S=
treet>
based on the violations alleged in the notices of violation: operation of =
an
auto repair business without a permit, the improper storage of motor vehic=
les,
and operating a junkyard without a permit.<span style=3D'mso-spacerun:yes'=
>&nbsp;
</span>The Complaint alleged violations of Bylaws &sect; 320 and 24 V.S.A.
&sect; 4443 (2003) for conducting the above activities without a valid zon=
ing
permit.<span style=3D'mso-spacerun:yes'>&nbsp; </span>The Town in its Comp=
laint also
requested that the Court award preliminary and permanent injunctive relief=
 and
fines of $100 per day for each day that the Defendants allegedly violated =
the
Bylaws.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>One
month later, in April 2004, the Town discovered Peter J. Nelson&#8217;s 20=
01
conditional use permit for the auto repair use, so the Town proceeded to p=
rosecute
only the improper storage of motor vehicles and the unpermitted operation =
of a
junk yard violations.</p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>After
obtaining counsel and stipulating to a preliminary injunction on or about =
<st1:date
Month=3D"5" Day=3D"26" Year=3D"2004">May 26, 2004</st1:date>, Defendants a=
ccepted
service of the Complaint through their attorney on <st1:date Month=3D"6" D=
ay=3D"4"
Year=3D"2004">June 4, 2004</st1:date>.<span style=3D'mso-spacerun:yes'>&nb=
sp;
</span>After accepting service and filing of the stipulation, Defendants&#=
8217;
attorney moved to withdraw from the representation on <st1:date Month=3D"6"
Day=3D"10" Year=3D"2004">June 10, 2004</st1:date>, which was granted on <s=
t1:date
Month=3D"8" Day=3D"24" Year=3D"2004">August 24, 2004</st1:date>. <span
style=3D'mso-spacerun:yes'>&nbsp;</span>Defendants thereafter decided to
represent themselves.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>Defendants
subsequently failed to answer the Town&#8217;s Complaint.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>They also failed to appear before=
 the
Court for an &#8220;in person&#8221; status conference on September 22, 20=
04,
even though notice of the conference was mailed to them on August 24, 2004,
with the Order granting their former attorney&#8217;s leave to withdraw his
representation.<span style=3D'mso-spacerun:yes'>&nbsp; </span>The Court re=
ceived
no further filings from any of the defendants until their new attorney fil=
ed
the pending Motion to Vacate on <st1:date Year=3D"2005" Day=3D"1" Month=3D=
"2">February
 1, 2005</st1:date>.</p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>On
<st1:date Year=3D"2004" Day=3D"21" Month=3D"10">October 21, 2004</st1:date=
>, the Town
moved for an entry of default as to Defendant Peter J. Nelson, which this =
Court
granted the following day.<span style=3D'mso-spacerun:yes'>&nbsp; </span>A=
fter
the Court issued and subsequently vacated an Entry Order dated November 29=
<sup>th</sup>
dismissing all claims because the Town failed to move for default or take =
any
action in regard to the other four Defendants, the Town moved for default =
judgment
against Defendant Angela LaForest, which this Court granted on December 14,
2004.<span style=3D'mso-spacerun:yes'>&nbsp; </span>On December 21 the Tow=
n moved
for and the Court granted default judgments against Defendants Laura Gordo=
n and
Mark Nelson.<span style=3D'mso-spacerun:yes'>&nbsp; </span>The Town did no=
t move
for a default judgment against Defendant James N. Nelson until <st1:date
Month=3D"3" Day=3D"1" Year=3D"2005">March 1, 2005</st1:date>, when they fi=
led their response
to Defendants&#8217; instant V.R.C.P. 60(b) Motion.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>The Motion for Default against Ja=
mes N.
Nelson is still pending.</p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>Each
Default Judgment Order issued by this Court requires Defendants to remove =
all
motor vehicles from the property that they do not own and that are not in
running condition, to remove all junk from the property, and to cease oper=
ation
of a junkyard.<span style=3D'mso-spacerun:yes'>&nbsp; </span>The Court lev=
ied
different fines on each Defendant, depending on when their Notices of Viol=
ation
were finalized.<span style=3D'mso-spacerun:yes'>&nbsp; </span>The Court im=
posed
fines of $30/day for each violation until the date of the preliminary
injunction, <st1:date Month=3D"5" Day=3D"26" Year=3D"2004">May 26, 2004</s=
t1:date>,
and then $20/day after that date for each day of the violation.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>The Judgments therefore required =
that
Peter J. Nelson pay a sum of $8,455, that Angela LaForest pay $6,500, and =
that
Mark Nelson and Laura Gordon each pay $6,620.</p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>Sometime
in early 2005, Defendants retained counsel, who on <st1:date Month=3D"2" D=
ay=3D"1"
Year=3D"2005">February 1, 2005</st1:date>, filed the pending Motion under
V.R.C.P. 60(b) for relief from the Default Judgments.</p>

<p class=3DMsoNormal align=3Dcenter style=3D'margin-top:12.0pt;margin-righ=
t:0in;
margin-bottom:12.0pt;margin-left:0in;text-align:center;text-indent:.5in;
line-height:150%'><b style=3D'mso-bidi-font-weight:normal'><u>Discussion<o=
:p></o:p></u></b></p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>A
motion to reopen judgment under Rule 60(b) is solely within the discretion=
 of the
Court. <span style=3D'mso-spacerun:yes'>&nbsp;</span>See <u>Pella Products=
, Inc.
v. Krutak</u>, 150 <st1:State><st1:place>Vt.</st1:place></st1:State> 81, 83
(1988).<span style=3D'mso-spacerun:yes'>&nbsp; </span>The Court is permitt=
ed to
reopen a judgment in a variety of situations including mistake, inadverten=
ce,
excusable neglect, newly discovered evidence, fraud, or for &#8220;any oth=
er
reason justifying relief from the operation of the judgment.&#8221;<span
style=3D'mso-spacerun:yes'>&nbsp; </span>V.R.C.P. 60(b).<span
style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>While
there is a strong desire to resolve litigation on the merits, <u>Desjarlai=
s v.
Gilman</u>, 143 <st1:State><st1:place>Vt.</st1:place></st1:State> 154,
158&#8211;59 (1983), other factors to be considered when ruling on a V.R.C=
.P.
60(b) motion include whether there was an absence of &#8220;culpable negli=
gence
or deliberate purpose to delay,&#8221; <u>Courtyard Partners v. Tanner</u>=
, 157
Vt. 638, 639 (1991), and &#8220;whether the defendant[s] ha[ve] demonstrat=
ed
any good or meritorious defenses to the plaintiff's claims&#8221;<span
style=3D'mso-spacerun:yes'>&nbsp; </span><u>Id</u>. at 157.</p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>In
this instance, there do not appear to be any extraordinary circumstances
warranting reopening of the default judgments.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Defendants have neither made an o=
ffer of
proof of the evidence that would contradict the violations that form the
factual basis for the default judgments,<a style=3D'mso-footnote-id:ftn1'
href=3D"#_ftn1" name=3D"_ftnref1" title=3D""><span class=3DMsoFootnoteRefe=
rence><span
style=3D'mso-special-character:footnote'><![if !supportFootnotes]><span
class=3DMsoFootnoteReference><span style=3D'font-size:12.0pt;font-family:"=
Times New Roman";
mso-fareast-font-family:"Times New Roman";mso-ansi-language:EN-US;mso-fare=
ast-language:
EN-US;mso-bidi-language:AR-SA'>[*]</span></span><![endif]></span></span></=
a>
nor did Defendants present evidence that the fines imposed were unreasonab=
le in
light of their violations.<span style=3D'mso-spacerun:yes'>&nbsp; </span>We
therefore deny Defendants&#8217; V.R.C.P. 60(b) motion to reopen.<span
style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>We
now turn to the Town&#8217;s pending Motion for Default Judgment against J=
ames
N. Nelson.<span style=3D'mso-spacerun:yes'>&nbsp; </span>We presume that M=
r.
Nelson offers the same arguments against entry of judgment against him as =
his
co-defendants offer in support of their motion to vacate the existing judg=
ments
against themselves.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Interest=
ingly,
Mr. Nelson has chosen to offer no further attack to the underlying Complai=
nt, such
as an answer or affirmative defenses.<span style=3D'mso-spacerun:yes'>&nbs=
p;
</span>Thus, he remains in default to this day.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Judgment is therefore appropriate
against Mr. Nelson as well.</p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:.5in;line-hei=
ght:150%'>Accordingly,
based on the foregoing, it is hereby ORDERED and ADJUDGED that
Defendants&#8217; V.R.C.P. 60(b) motion is DENIED.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Plaintiff&#8217;s motion for entr=
y of
default judgment against Defendant James N. Nelson is hereby GRANTED.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>A hearing shall be scheduled by t=
he
Court Manager to determine the appropriate level of fines to be imposed on
Defendant James N. Nelson and whether such fines should run jointly and
severally with the fines imposed on the other Defendants.</p>
