subdivision and therefore it individually claims &#8216;interested party&#=
8217;
status.&#8221;<span style=3D'mso-spacerun:yes'>&nbsp; </span>However, Mr.
Baribault&#8217;s attempt falls short of fulfilling the statutory definiti=
on.<span
style=3D'mso-spacerun:yes'>&nbsp; </span><span
style=3D'mso-spacerun:yes'>&nbsp;</span>24&nbsp;V.S.A. &sect; 4465(b)(1) &=
amp;
(3) define an &#8220;interested person&#8221; as one who either owns title=
 to
or occupies property in the immediate neighborhood of the proposed
development.<span style=3D'mso-spacerun:yes'>&nbsp; </span>We believe that=
 these
statutory requirements require more than the casual use of property that M=
r.
Baribault&#8217;s assertion suggests.<span style=3D'mso-spacerun:yes'>&nbs=
p;
</span>We therefore conclude that JCCRG is not entitled to interested pers=
on
status in this proceeding.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'margin-bottom:6.0pt;text-align:justify;text-=
indent:
.5in;line-height:150%'><span style=3D'font-size:12.0pt;line-height:150%'>A=
lthough
Appellees&#8217; Motion to Dismiss does not give specific reference, it is=

style=3D'mso-spacerun:yes'>&nbsp; </span>Thus, the final date that a notic=
e of
appeal could be filed to initiate an action in this Court would have been =

eight:150%'>Monday,

cus our
analysis upon the filings of JCCRG and Patricia Carroll, as they are the o=
nly
entities that filed appeals on or before the filing deadline.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>As this Court previously stated i=
n <u>Emanuel</u>,
supra, this Court will have jurisdiction to entertain motions to amend,
substitute or modify notices of appeal only if the JCCRG and Carroll filin=
gs as
of January 3<sup>rd</sup> satisfied the standing requirements of 24 V.S.A.
&sect;4465(b).<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'margin-bottom:6.0pt;text-align:justify;text-=
indent:
.5in;line-height:150%'><span style=3D'font-size:12.0pt;line-height:150%'>W=
e have
already determined that JCCRG does not satisfy the criteria for interested
party status in 24 V.S.A. &sect;4465(b).<span style=3D'mso-spacerun:yes'>&=
nbsp;
</span>Anticipating this determination, Mr. Baribault, joined by Mr. Carro=
ll,
request that they be substituted as appellants for JCCRG.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>But their request for substitutio=
n was
filed with the Court on </span><st1:date Month=3D"3" Day=3D"7" Year=3D"200=

s to
Mrs. Carroll, there is little doubt that her appeal was timely filed.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>However, a further legal question
remains:<span style=3D'mso-spacerun:yes'>&nbsp; </span>do her actions, or =
the
actions now alleged to have been taken on her behalf, qualify her to be an
interested party under 24 V.S.A. &sect;4465(b)?<span
style=3D'mso-spacerun:yes'>&nbsp; </span><o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'margin-bottom:6.0pt;text-align:justify;text-=
indent:
.5in;line-height:150%'><span style=3D'font-size:12.0pt;line-height:150%'>M=
rs.
Carroll concedes that she did not participate on her own behalf in the hea=
rings
on Appellee&#8217;s </span><st1:date Month=3D"9" Day=3D"15" Year=3D"2004">=
<span
 style=3D'font-size:12.0pt;line-height:150%'>September 15, 2004</span></st=
1:date><span
style=3D'font-size:12.0pt;line-height:150%'> application for final subdivi=
sion
approval.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Rather, she assert=
s that
her husband, Jim Carroll, made comments and presented documentation on her
behalf.<a style=3D'mso-footnote-id:ftn6' href=3D"#_ftn6" name=3D"_ftnref6"=
 title=3D""><span
class=3DMsoFootnoteReference><span style=3D'mso-special-character:footnote=
'><![if !supportFootnotes]><span
class=3DMsoFootnoteReference><span style=3D'font-size:12.0pt;font-family:"=
Times New Roman";
mso-fareast-font-family:"Times New Roman";mso-ansi-language:EN-US;mso-fare=
ast-language:

style=3D'mso-spacerun:yes'>&nbsp; </span>But the record below is absent of=
 any
reference to Mr. Carroll&#8217;s testimony or documents being offered on h=
is
wife&#8217;s behalf.<span style=3D'mso-spacerun:yes'>&nbsp; </span>While i=
t may
have been Mr. or Mrs. Carroll&#8217;s intention that his comments and docu=
ments
were to be on her behalf as well, it was incumbent upon either Mr. or Mrs.
Carroll to announce their intentions.<span style=3D'mso-spacerun:yes'>&nbs=
p;
</span>Their failure to do so meant that no other party (Applicant include=
d) was
provided with notice that Mrs. Carroll was participating in the DRB
proceedings.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Without such no=
tice,
we can only conclude that the comments and documents offered by Mr. Carroll
were offered on his behalf only.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'margin-bottom:6.0pt;text-align:justify;text-=
indent:
.5in;line-height:150%'><span style=3D'font-size:12.0pt;line-height:150%'>M=
rs.
Carroll did attend and participate in the hearings on an earlier applicati=
on by
the Appellee here for preliminary site plan approval.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>But those hearings in which Mrs. =
Carroll
participated resulted in an approval that was granted in October, 2003.<sp=
an
style=3D'mso-spacerun:yes'>&nbsp; </span>No party to that proceeding, incl=
uding
Mrs. Carroll, appealed that decision.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'margin-bottom:6.0pt;text-align:justify;text-=
indent:
.5in;line-height:150%'><span style=3D'font-size:12.0pt;line-height:150%'>M=
any </span><st1:State><st1:place><span
  style=3D'font-size:12.0pt;line-height:150%'>Vermont</span></st1:place></=
st1:State><span
style=3D'font-size:12.0pt;line-height:150%'> municipalities require separa=
te
applications for preliminary and final site plan approval for what is
essentially a single request from a property developer:<span
style=3D'mso-spacerun:yes'>&nbsp; </span>may I be permitted to subdivide t=
his
property.<span style=3D'mso-spacerun:yes'>&nbsp; </span>These separate
applications can often cause multiple filings in this Court, since appella=
nts
often file appeals from preliminary determinations, fearful that they woul=
d lose
their appeal rights by waiting until the final determination is made.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>It would be procedurally more eff=
icient,
for the parties and this Court, if preliminary and final determinations co=
uld
be considered as one.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Unfortunately, we find no statutory authority to do so.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Therefore, we cannot look to Mrs.
Carroll&#8217;s participation in the preliminary proceeding to satisfy her
statutory requirement of participation in the final subdivision approval h=
ere.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'margin-bottom:6.0pt;text-align:justify;text-=
indent:
.5in;line-height:150%'><span style=3D'font-size:12.0pt;line-height:150%'>We
therefore conclude that Mrs. Carroll cannot be considered a proper
appellant.<span style=3D'mso-spacerun:yes'>&nbsp; </span>As no party filed=
 a
timely notice of appeal, we are therefore left without jurisdictional auth=
ority
over this proceeding.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'margin-bottom:6.0pt;text-align:justify;text-=
indent:
.5in;line-height:150%'><span style=3D'font-size:12.0pt;line-height:150%'>We
recognize that other parties subsequently appeared or cross-appealed in th=
is
proceeding and have substantive concerns regarding the proposed
development.<span style=3D'mso-spacerun:yes'>&nbsp; </span>It is unfortuna=
te that
the case will not be decided on its merits.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>But the importance of respecting =
the
jurisdictional limits of this Court requires the decision rendered here.<o=
