asserts in its Motion for Partial Summary Judgment that the Planning Commi=
ssion
in the first instance, and this Court in the second instance, is authorize=

the applicable statutes, the Town Ordinance provisions and the Town Plan, =

impose such conditions.<span style=3D'mso-spacerun:yes'>&nbsp; </span>On t=
his
issue, we agree with the Town.<o:p></o:p></span></p>

unicipal
authority to impose conditions on land use approval derives from the gener=
al
enabling provisions contained in 24 V.S.A., Chapter 117 (2004).<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Specifically, a </span><st1:State=
><st1:place><span
  style=3D'font-size:12.0pt;line-height:150%'>Vermont</span></st1:place></=
st1:State><span
style=3D'font-size:12.0pt;line-height:150%'> municipality is authorized, w=
hen
&#8220;rendering a decision in favor of the applicant, . . . [to] attach
additional reasonable conditions and safeguards as it deems necessary to
implement the purposes of this chapter and the pertinent bylaws and the
municipal plan then in effect.&#8221;<span style=3D'mso-spacerun:yes'>&nbs=
p;
</span>24 V.S.A. &sect;&nbsp;4463(b)(2) (2004).<o:p></o:p></span></p>

he
Applicants here do not directly challenge the Town&#8217;s authority deriv=
ed
from Chapter 117.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Rather, Ha=
rvey and
Symmes assert that the Town carries the burden to establish the propriety =
of
the conditions imposed on any permit approval.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>However, Harvey and Symmes do not
provide this Court with a legal foundation for their assertion that a muni=
cipality
carries this burden.<span style=3D'mso-spacerun:yes'>&nbsp; </span>We cann=
ot adopt
their assertion.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'margin-bottom:6.0pt;text-align:justify;text-=
indent:
.5in;line-height:150%'><span style=3D'font-size:12.0pt;line-height:150%'>S=
ection 4463(b)(2)
clearly authorizes a municipality to impose conditions on its approval of a
subdivision application, so long as the municipal panel &#8220;deems&#8221=
; the
conditions imposed &#8220;necessary to implement the purposes&#8221; of the
statute, the town plan and subdivision regulations.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Thus, if an appropriate municipal=
 panel
(or this Court on appeal) determines that a permit should be granted, it m=
ay do
so on conditions that it deems appropriate under the applicable statutory =
and
municipal guidelines.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'margin-bottom:6.0pt;text-align:justify;text-=

procedural light, it is premature for this Court to determine what specific
conditions, if any, should be attached to any approval of the Harvey and S=
ymmes
subdivision application.<span style=3D'mso-spacerun:yes'>&nbsp; </span>A m=
erits
hearing is necessary to determine if the material facts support approval o=
f the
pending subdivision application and, if so, what conditions are appropriat=
e to
attach.<span style=3D'mso-spacerun:yes'>&nbsp; </span>But on the question =
of
whether the Planning Commission below, or this Court on appeal, has the
authority to impose conditions on a subdivision approval, the state enabli=
ng
statute clearly allows this Court to impose conditions if they are necessa=
rily
connected to the lawful purposes contained in the Town Plan and Bylaws.<o:=
p></o:p></span></p>

<p class=3DMsoNormal style=3D'margin-bottom:6.0pt;text-align:justify;text-=
indent:
.5in;line-height:150%'><span style=3D'font-size:12.0pt;line-height:150%'>I=
t is
uncontested in this appeal that the property proposed to be subdivided is
located adjacent to </span><st1:PlaceType><span style=3D'font-size:12.0pt;
 line-height:150%'>Mt.</span></st1:PlaceType><span style=3D'font-size:12.0=
pt;
line-height:150%'> Philo State Park, on a private road that may be challen=
ging
for emergency response vehicles to navigate.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>When viewed in a light most favor=
able to
the Town, conditions that restrict the building envelope, screening, and f=
acilities
for access to water by fire responders (such as dry hydrants) could certai=
nly
be deemed reasonably related to the statutory purposes for permit conditio=
ns. <span
style=3D'mso-spacerun:yes'>&nbsp;</span>For these reasons, </span><st1:Cit=
y><st1:place><span
  style=3D'font-size:12.0pt;line-height:150%'>Harvey</span></st1:place></s=
t1:City><span
style=3D'font-size:12.0pt;line-height:150%'> and Symmes&#8217; Motion must=
 be
denied.<o:p></o:p></span></p>

he
Town&#8217;s Motion for Partial Summary Judgment raises a related issue: i=
s it
appropriate for this Court to rule on whether the Planning Commission
&#8220;exceeded its authority&#8221; in imposing conditions to its approva=
l of
this subdivision application.<span style=3D'mso-spacerun:yes'>&nbsp; </spa=
n>See Cross-Appellants&#8217;
Statement of Questions 5&#8211;14.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Our jurisdictional responsibility in <i style=3D'mso-bidi-font-styl=
e:normal'>de
novo</i> proceedings is not to judge the actions of the appropriate munici=
pal
panel below, but rather to stand in its place and render a decision, based=
 upon
the admissible facts presented in support of and in opposition to an appli=
cation.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>For this reason, we must strike <=
/span><st1:City><st1:place><span
  style=3D'font-size:12.0pt;line-height:150%'>Harvey</span></st1:place></s=

the general question of what conditions should be imposed on any approval =
of
the pending subdivision application.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>That question will be answered, based upon the admissible evidence
presented at the merits hearing.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'margin-top:0in;margin-right:0in;margin-botto=
m:6.0pt;
margin-left:.25in;text-align:justify;line-height:150%;tab-stops:.75in'><b

line-height:150%'>II.<span style=3D'mso-tab-count:1'>&nbsp;&nbsp;&nbsp;&nb=
sp;&nbsp;&nbsp;&nbsp; </span>Does
the Ordinance require easements to be depicted on preliminary and final
subdivision plats?<o:p></o:p></span></u></b></p>

<p class=3DMsoNormal style=3D'margin-bottom:6.0pt;text-align:justify;text-=

.5in;line-height:150%'><span style=3D'font-size:12.0pt;line-height:150%'>A=
ppellants&#8217;
Motion for Summary Judgment addresses the sole question they assert in this
appeal: do the Bylaws require reference to easements on the preliminary and
final plats that are approved for a subdivision?<span
style=3D'mso-spacerun:yes'>&nbsp; </span>This issue is separate from the H=
arvey
and Symmes&#8217; Question 4, which asks this Court to determine if the
easement asserted by the Bevans is valid.<span style=3D'mso-spacerun:yes'>=
&nbsp;
</span>The latter Question is discussed in more detail below.<o:p></o:p></=
span></p>

<p class=3DMsoNormal style=3D'margin-bottom:6.0pt;text-align:justify;text-=
indent:
.5in;line-height:150%'><span style=3D'font-size:12.0pt;line-height:150%'>B=
ylaws &sect;&sect;
10 and 11 specifically require that preliminary and final subdivision plat=
s show
&#8220;existing easements.&#8221;<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Bylaws &sect;&sect; 10(A)(3), 11(A)(2).<span
style=3D'mso-spacerun:yes'>&nbsp; </span>In response to the Bevans&#8217; =
claims,
Harvey and Symmes appear to dispute the specific boundary lines of the
Bevans&#8217; easement, but do not appear to dispute the general existence=
 of
the easement.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Harvey and Sym=
mes&#8217;
challenge to the specific location of the easement appears to rest upon wh=
at the
Bevans characterize as a scrivener&#8217;s error or omission now memoriali=
zed
in the Charlotte Land Records.<span style=3D'mso-spacerun:yes'>&nbsp; </sp=
an><o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'margin-bottom:6.0pt;text-align:justify;text-=
indent:
.5in;line-height:150%'><span style=3D'font-size:12.0pt;line-height:150%'>As
discussed in more detail below, it is not within this Court&#8217;s
jurisdiction to define the parameters of the Bevans&#8217; easement.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>However, the issue within our jur=
isdiction&#8213;whether
the applicable subdivision regulations require that an easement must be sh=
own
on subdivision plats&#8213;does not appear to be disputed by Harvey and Sy=

Town&#8217;s Motion for Dismissal of Cross-Appellants&#8217; Question 4 as=

this Court to affirm that it is not a court of general jurisdiction and th=
at
its jurisdiction is limited to matters enumerated in 10 V.S.A. &sect; 8504
(2005), governing appeals to the Environmental Court.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Harvey and Symmes ask in their Qu=
estion
4 &#8220;[w]hether the deed recorded in Volume 57, Page 122 of the Charlot=
te
Land Records creates a valid easement.&#8221;<span
style=3D'mso-spacerun:yes'>&nbsp; </span><o:p></o:p></span></p>

to the validity of easements are not properly before this Court, as we do =
not have
jurisdiction over matters involving private property rights, such as the
construction and validity of easements, deeds, and property boundaries.<sp=

presented to the Superior Court.<span style=3D'mso-spacerun:yes'>&nbsp; </=
span>However,

  150%'>Environmental Court</span></st1:address></st1:Street><span
style=3D'font-size:12.0pt;line-height:150%'> does not have jurisdiction to

</span>Thus, while we have determined that the Bylaws lawfully require an
applicant to show easements on their proposed subdivision plats, we leave =
it to
the parties here to challenge the validity of the purported easement in Su=
perior
Court.<span style=3D'mso-spacerun:yes'>&nbsp; </span>We decline to address=
 the
issue raised in Harvey and Symmes&#8217; Question 4.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Therefore, that Question is also
stricken from consideration in this appeal.<o:p></o:p></span></p>

Mt. Philo; or whether the proposed screening of the building is adequate in
light of the directives from the applicable municipal ordinance.<span

gest
that further screening conditions are unnecessary, but we are uncertain of=
 the
Question&#8217;s purpose, due to its vagueness.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Because of the uncertainty that t=
his Question
creates, Harvey and Symmes should consider the more general issues that the
Question raises when the parties address the issue of what conditions are
appropriate to attach, in the event this Court determines that the </span>=
